TERMS AND CONDITIONS

These Terms & Conditions apply to all work carried out by Cedar Park Tree Care Ltd (“the Company”). By accepting a quotation or permitting work to proceed, the Client agrees to be bound by these Terms & Conditions.

1. Scope of Services

1.1 The Company provides arboricultural services including, but not limited to, tree pruning, removal, stump grinding, hedge work, site clearance, and associated services.
1.2 The scope of work is limited strictly to that described in the written quotation.
1.3 Any additional work requested or required due to unforeseen site conditions will be quoted and charged separately.

2. Quotations and Acceptance

2.1 All quotations are valid for 30 days unless otherwise stated.
2.2 Quotations are based on information provided by the Client and/or a site inspection.
2.3 Acceptance may be given verbally, in writing, by email, text message, or by allowing work to commence.

3. Client Responsibilities

3.1 The Client is responsible for:

Ensuring safe and clear access to the site

Removing vehicles, pets, and personal belongings from the work area

Informing the Company of underground or overhead services.

3.2 The Client must confirm whether trees are subject to Tree Preservation Orders (TPOs) or located within a Conservation Area.
3.3 The Company accepts no liability for delays or additional costs arising from incorrect or incomplete information supplied by the Client.

  1. Health and Safety4.1 All work is carried out in accordance with current Health & Safety legislation, industry best practice, and risk assessments.
    4.2 The Company reserves the right to stop work if site conditions are unsafe.
    4.3 Clients must ensure that members of the public, children, and pets are kept clear of the work area at all times.
    4.4 The Company may postpone or reschedule work due to unsafe weather conditions without penalty to the Client.

5. Waste Removal

5.1 All green waste will be removed unless otherwise stated in the quotation.
5.2 Timber, logs, or woodchip may be left on site at the Client’s request.

6. Cancellation Policy

6.1 Cancellations must be made in writing (email or text message accepted).
6.2 Cancellation charges apply as follows:

More than 3 days’ notice: No charge

24–48 hours’ notice: 50% of the quoted price

Less than 24 hours’ notice or no access on arrival: 75% of the quoted price

6.3 Charges reflect labour scheduling, equipment allocation, and operational costs.
6.4 The Company reserves the right to waive cancellation fees at its discretion.

7. Termination of Services

7.1 The Company reserves the right to terminate or suspend services immediately if:

– Unsafe working conditions arise

– The Client breaches these Terms & Conditions

– Abuse or unreasonable behaviour is directed at staff.

7.2 In such cases, the Client remains liable for work completed and reasonable costs incurred to that point.

8. Payment Terms

8.1 Payment is due on completion of works, unless otherwise agreed in writing.
8.2 Invoices must be paid within 3 days.
8.3 Late payments may incur interest and recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998.

9. Guarantee

9.1 All work is carried out to a professional standard in line with industry guidance.

9.2 Living materials (trees, hedges, plants) are subject to natural growth and environmental conditions; therefore, no guarantee is given on future growth, health, or survival.
9.3 Any concerns regarding workmanship must be raised within 7 days of completion.

10. Liability and Insurance

10.1 The Company holds appropriate Public Liability Insurance.
10.2 The Company is not liable for:

– Pre-existing defects to property or surfaces

– Damage to underground services not disclosed by the Client

– Natural ground disturbance resulting from tree works
10.3 Liability is limited to the value of the work carried out.

11. Complaints

11.1 Any complaints must be submitted in writing within 7 days of completion.
11.2 The Company will make reasonable efforts to resolve any issues promptly and fairly.

12. Governing Law

These Terms & Conditions are governed by English law, and any disputes shall be subject to the jurisdiction of the courts of England and Wales.

  1. Stump grinding and removal.

13.1 Site Conditions:  We will assess the site conditions upon arrival to determine the feasibility of stump grinding and removal. – We reserve the right to refuse service or adjust pricing if unexpected site conditions, such as buried utilities or extensive root systems are encountered.

13.2 Safety Precautions:  We prioritizes safety during all aspects of stump grinding and removal. Clients and bystanders must maintain a safe distance from the work area during the service. Pets should be kept indoors or away from the work area to prevent accidents or injury.

13.3 Damage Liability:  While we take precautions to minimize damage to surrounding property, including underground utilities and landscaping, we are not liable for any damage incurred during the stump grinding and removal process. Clients are required to:

– Mark underground utilities

– provide a map clearly marking the underground utilities.

– inform our team of any potential hazards prior to service.

13.4 Completion of Service: We will complete the stump grinding and removal service in a timely manner, as specified in the initial estimate. Upon completion of the service, our team will leave the work area in a neat and tidy condition. All debris will remain onsite in the place of the stump unless clearly stated on the quote that the stump grinding debris will be removed.

  1. Poor Weather or Ground Conditions

14.1 Please carefully review the following terms and conditions regarding our exclusion of our liability for damage caused to ground or grass due to poor weather or ground conditions:

14.2 Exclusion of Liability: Cedar Park Tree Care Ltd shall not be held liable for any damage caused by foot, machinery or vehicles to ground or grass, including but not limited to soil compaction, rutting, or damage to turf resulting from poor weather conditions (e.g., rain, snow, frost) or ground conditions (e.g., soft, muddy terrain).

14.3 Assumption of Risk: Clients acknowledge and accept the inherent risks associated with performing outdoor landscaping services, tree work, hedge trimming and including stump grinding and removal, under varying weather and ground conditions.

14.4 Clients agree to assume full responsibility for any potential damage to the ground or grass that may occur because of poor weather or ground conditions during the provision of services by Cedar Park Tree Care Ltd.

14.5. Client Responsibilities: Clients are responsible for assessing ground conditions and notifying Cedar Park Tree Care Ltd of any known hazards or concerns within a minimum 24 hours prior to the commencement of services.

14.6 Weather Monitoring:  Cedar Park Tree Care Ltd reserves the right to monitor weather conditions leading up to and during the provision of services. In the event of adverse weather conditions that pose a risk to the safety of our team or the integrity of the work site, Cedar Park Tree Care Ltd may delay or reschedule services at its discretion.

14.7 Limitation of Liability: To the fullest extent permitted by law, Cedar Park Tree Care Ltd shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to damage caused to ground or grass due to poor weather or ground conditions. – In no event shall Cedar Park Tree Care Ltd’s total liability exceed the amount paid by the client for the specific service in question.

14.8 Indemnification: Clients agree to indemnify, defend, and hold Cedar Park Tree Care Ltd harmless from and against any claims, damages, liabilities, losses, and expenses arising from or related to damage caused to ground or grass as described herein.

14.9 Severability: If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. By engaging Cedar Park Tree Care Ltd for services, clients acknowledge that they have read, understood, and agreed to the terms and conditions outlined above regarding the exclusion of liability for damage caused to ground or grass due to poor weather or ground conditions.
